Possessing a gun while under a restraining order is a crime

There are many things a person needs to know if he or she has been accused of domestic violence in Tennessee. When a restraining order is involved, the potential complications for defendants can increase even more. For example, if you have been named the subject of a restraining order, it is illegal for you to possess a gun. Below is an example for you to consider.

Your spouse has accused you of domestic violence, moved away from your residence and acquired a restraining order. As a gun owner, you have complied with the law by getting rid of your firearms. Unfortunately, you have overlooked the rifle given to you by your father, which is safely stored in your basement. If your spouse knows this and alerts the authorities, you could find yourself charged with a gun crime, worsening your situation significantly.

The above is just one of a myriad of situations that have the potential to wreck your defense. Think of it this way: You are facing terrible allegations, which can compromise your emotional stability and your ability to think rationally. It is all too easy to overlook important details that could make or break your case.

For your own protection, consider acquiring a criminal defense attorney to help you sort through the details and strengthen your defense. A solid attorney knows the laws associated with protective orders and can help you make sure you do not inadvertently violate the terms of the order. If you have already been charged with a gun crime while under a Tennessee protective order, it is unwise to proceed without legal representation.
